Court orders town planners to measure bank’s building in N10b Braithwaite suit

Justice Doris Okuwobi of Lagos High Court, sitting in Ikeja, on Thursday, gave an order that the President of the Nigerian Institute of Town Planners should prepare a comprehensive report that would contain the findings and measurement of Standard Chartered Bank Nigeria Limited, a 14-floor commercial building located at 142 Ahmadu Bello Way, Victoria Island, Lagos, to the house of elder statesman, Dr. Tunji Braithwaite.

Justice Okuwobi made the order in the N10 billion suit filed by Braithwaite against the bank for constructing a 15-storey building and a multi-level car park opposite his residence with an alleged illegal permit.

The order also followed an application filed by Braithwaite, dated October 6, 2015, seeking an order of court “directing the President of the Nigerian Institute of Town Planners to enter the defendant’s commercial building of 14 floors comprising a five-level car park at no. 142 Ahmadu Bello Way, Victoria Island, Lagos, the subject-matter of this suit, in the presence of the parties, herein and/or their counsel, to undertake physical measurement of the setback and airspace of the said defendant’s building, etc.”

Defendant’s counsel, Mr. Adeniyi Adegbonmire (SAN) did not oppose the application.

He prayed the court “to make consequential order that both parties be at liberty to call whoever made the measurement to be available for cross examination, once we agree on the date of the measurement, my client is ready to grant the person entry to the premises.”
